Missing the Income Tax Return (ITR) deadline is a common concern for taxpayers in India. While it can lead to penalties and compliance issues, the law provides multiple remedies that allow taxpayers to file their returns even after the due date, subject to certain conditions.

Financial Year vs Assessment Year

The financial year runs from 1 April to 31 March, while the assessment year is when the income is reported and taxed. For example, income earned during FY 2023–24 is reported in AY 2024–25.

What is an Income Tax Return (ITR)?

A formal statement filed with the Income Tax Department capturing income, deductions, and tax liability — covering salary, business/profession, house property, capital gains and other sources.

Due Dates for Filing ITR

  • 31 July → Individuals (non-audit cases)
  • 31 October → Audit cases (companies, firms)
  • 30 November → Transfer pricing cases

What Happens If You Miss the ITR Deadline?

  • Late filing fees under Section 234F

Remedies Available After Missing the Deadline

1. Belated Return — Section 139(4)

  • Late filing fees up to ₹5,000 (₹1,000 for lower income)
  • Interest liability may apply
  • Certain losses cannot be carried forward

2. Updated Return (ITR-U)

  • Filing or correction within 24 months from the end of the assessment year
  • Cannot be used to claim refunds
  • Applicable only when additional tax is payable

3. Condonation of Delay — Section 119(2)

Approval granted only in genuine hardship cases — medical emergencies, business closure or situations beyond the taxpayer's control.

Practical Steps After Missing the Deadline

  • Check whether you can file a belated or updated return
  • Gather Form 16, AIS, and bank statements
  • Calculate any applicable interest or penalties
  • File the return as soon as possible
  • Complete verification within 30 days
